Terms of Service

BITBOUND PRIVATE LIMITED ("BITBOUND PRIVATE LIMITED", "we", "us", or "our") is the online background-removal service available at https://bitbound.in. The service is operated by BITBOUND PRIVATE LIMITED, a private limited company incorporated under the Companies Act, 2013.

These Terms constitute an electronic record under the Information Technology Act, 2000 and do not require any physical or digital signature. By accessing or using the service you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Refund & Cancellation Policy, which are incorporated by reference.

If you do not agree with any part of these Terms, you must not access or use the service.

• "Service" means the BITBOUND PRIVATE LIMITED website, application, and background-removal features made available at https://bitbound.in.
• "User", "you", or "your" means any person who accesses or uses the Service.
• "Account" means the account you create and access through our authentication provider.
• "Credit" means a prepaid unit of usage that entitles you to one successful background-removal job.
• "Job" means a single request to process an uploaded image and produce a background-removed result.
• "Input" means an image you upload to the Service; "Output" means the processed result we return to you.

You must be at least 18 years of age and competent to enter into a binding contract under the Indian Contract Act, 1872. By using the Service you represent that you meet these requirements and, if you use the Service on behalf of an organisation, that you are authorised to bind that organisation to these Terms.

The Service is not directed at children. We do not knowingly permit persons under 18 to create an account or upload images.

Access to the processing tool requires an account created through our authentication provider. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You agree to provide accurate information and to notify us promptly of any unauthorised use.

The Service removes the background from images you upload using automated foreground-segmentation technology. Processing is provided on a best-effort basis; results depend on the content, quality, and resolution of your Input.

• Credits are prepaid usage units purchased in Indian Rupees (INR) through credit packs.
• A successful Job consumes exactly one (1) Credit.
• A failed Job does not consume any Credit.
• You must hold at least one (1) Credit before you can start a Job.
• Credits do not expire.
• Credits are non-transferable, hold no monetary value, are not a deposit, and cannot be exchanged or redeemed for cash.

You are solely responsible for the images you upload and must hold all rights, licences, and consents necessary to process them, including the rights of any person depicted. In line with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you must not upload, process, or transmit any content that:

• belongs to another person and to which you do not have any right;
• is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy, or harmful to children;
• is hateful, racially or ethnically objectionable, or otherwise unlawful in any manner;
• infringes any patent, trademark, copyright, or other proprietary or intellectual property right;
• violates any law for the time being in force, or is intended to deceive or mislead;
• impersonates another person, or contains software viruses or any malicious code;
• threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign States, or public order.

We may remove content, suspend processing, or terminate access where we reasonably believe these rules have been breached, and may disclose information to law-enforcement authorities where required by law.

You retain all ownership of your Input and Output. We do not claim ownership of your images. You grant us a limited, non-exclusive, royalty-free licence to host, store, and process your Input for the sole purpose of providing the Service to you (including generating, storing, and delivering your Output) and to operate, secure, and improve the Service as described in our Privacy Policy.

Inputs and Outputs are retained for 30 days to allow you to download your results, after which they are automatically deleted. You may delete your image assets immediately from your history at any time. Further detail is set out in our Privacy Policy.

The Service, including its software, design, text, logos, and trademarks, is owned by BITBOUND PRIVATE LIMITED or its licensors and is protected by applicable intellectual-property laws. Except for the rights expressly granted to you to use the Service, no licence or right is granted to you in any of our intellectual property.

The Service relies on third-party providers, including our authentication provider, our cloud infrastructure and image-processing provider, and our third-party payment partners. Your use of those features is also subject to the relevant provider's terms. We are not responsible for the acts or omissions of third-party providers beyond our reasonable control.

Credit-pack prices are displayed in INR on the pricing page and are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise. Payments are collected by our third-party payment partners; we do not store your full card or banking details. Purchases are governed by our Refund & Cancellation Policy.

The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or that any Output will meet your specific requirements. To the maximum extent permitted by law, we disclaim all implied warranties, while preserving any rights you have as a consumer under the Consumer Protection Act, 2019 that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, BITBOUND PRIVATE LIMITED shall not be liable for any indirect, incidental, special, or consequential loss, or any loss of profits, data, goodwill, or business, arising out of or in connection with your use of the Service.

Our total aggregate liability arising out of or relating to the Service shall not exceed the total amount you paid to us for credits in the three (3) months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable Indian law.

You agree to indemnify and hold harmless BITBOUND PRIVATE LIMITED, its directors, officers, and employees from any claim, demand, loss, or liability (including reasonable legal costs) arising out of your Input, your breach of these Terms, or your violation of any law or the rights of a third party.

We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or to protect the Service or other users. You may stop using the Service and request deletion of your data at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnity) will survive.

We may update these Terms from time to time. Material changes will be notified through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of India. Subject to applicable consumer-protection law, the courts at Faridabad, Haryana shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the name and contact details of the Grievance Officer are published below. You may contact the Grievance Officer to report any concern, complaint, or violation relating to the service or your data.

We will acknowledge every complaint within 24 hours and make best efforts to resolve it within 15 days of receipt, as required by applicable law. Please include your registered email and enough detail for us to identify the relevant account, job, or transaction.
